1. Who these terms apply to#

1.1 These terms apply to everyone who uses www.find-care.co.uk. By using the site you agree to them. If you do not agree to them, do not use the site.

1.2 Providers listed on the site are also bound by the provider agreement, which governs listing, enquiries and charges. Where the provider agreement conflicts with these terms, the provider agreement prevails for providers.

1.3 You must be 18 or over to send an enquiry through this site.

2. Definitions#

2.1 In these terms:

• “we”, “us” and “Find-Care” mean the operator of this site, identified in clause 10.2;
• “you” means the person using the site;
• “provider” means a care home or home care service listed on the site;
• “enquiry” means a request by you for us to pass your contact details to one or more providers;
• “profile” means the page on this site describing a provider.

3. What the service does#

3.1 Find-Care is a directory of care homes and home care services in England. We publish information about providers and, at your request, pass your contact details to providers so that they may contact you.

3.2 We do not provide care and we do not arrange care.

3.3 Any assessment, contract, booking or payment for care is between you and the provider. We are not a party to it, and we do not act as agent for you or for the provider.

3.4 Use of the site is free for families. We do not charge you for anything on it.

3.5 We do not guarantee that the site will be available without interruption, or that any provider will respond to an enquiry.

4. Using the site#

4.1 You must not:

• use the site for any unlawful purpose;
• send an enquiry on behalf of another person without that person’s knowledge, or send an enquiry that is not genuine;
• copy, extract or republish our listings, ratings, database or content for a competing service;
• access or attempt to access any account, provider portal or administrative area you are not authorised to use;
• introduce malicious code, or interfere with the operation of the site.

4.2 We may suspend or withdraw access to the site, and remove a provider from it, where this clause is breached.

4.3 You may link to any page on this site.

5. Information we are responsible for#

5.1 The CQC rating shown on a profile is recorded by us from the Care Quality Commission’s public register and re-checked at least every 90 days. Providers cannot set or alter it.

5.2 We list a provider only where the criteria in our listing and ranking policy are met.

5.3 Sponsored placements are shown in a separate box marked Sponsored and are not part of the search results.

5.4 Where we become aware that information under this clause is wrong, we correct it. Report an error under section 3 of our complaints procedure.

6. Exclusions and liability#

6.1 We verify information during onboarding and vetting, including the provider’s CQC registration, rating and regulated activity. Fees, availability, photographs, staffing and service descriptions on a profile are supplied by the provider, are not individually verified, and may change after we have checked them. You should confirm them with the provider before relying on them.

6.2 Nothing on this site is care, medical, legal or financial advice. It is not a substitute for a professional assessment of a person’s care needs.

6.3 We are not liable for the care provided by a provider, for any act or omission of a provider, or for any loss arising from an agreement between you and a provider.

6.4 A CQC rating records the Care Quality Commission’s findings at the date of inspection. It is not a warranty by us as to the care any individual will receive.

6.5 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. If you are a consumer, your statutory rights are not affected.

6.6 This site is provided to you free of charge and for private, non-commercial use. If you use it for any commercial purpose, we are not liable to you for loss of profit, loss of business, business interruption, or loss of business opportunity.

6.7 We are not liable for any loss that was not reasonably foreseeable at the time you used the site.

6.8 The limits of our liability to a listed provider are set out in the provider agreement, not in this clause.

6.9 We are not responsible for the content of any external website linked from this site, including the Care Quality Commission’s.

7. Enquiries and personal information#

7.1 When you send an enquiry you instruct us to pass your contact details to the providers identified to you before you confirm. We pass them to those providers only.

7.2 You must not include medical or diagnosis details in an enquiry. The enquiry form asks for preferences only.

7.3 Once a provider receives your details, that provider is responsible as a data controller for the information it then holds about you.

7.4 Our privacy policy sets out what we collect, how long we keep it, and your rights.

8. Intellectual property#

8.1 The content, design, database and trade marks of this site belong to us or our licensors.

8.2 You may read, print and share pages for your own personal use. You may not reproduce our content or database commercially without our written permission.

8.3 Postcode district data is used under the Open Government Licence v3.0. The required acknowledgements appear in the footer of every page.

9. Changes and termination#

9.1 We may amend these terms. The date shown at the top of this page is the date of the last amendment. Continuing to use the site after an amendment constitutes acceptance of the amended terms.

9.2 We may withdraw or alter any part of the site at any time.

9.3 Clauses 6, 8 and 10 survive any termination or withdrawal of access.

10. Law and contact#

10.1 These terms, and any dispute arising out of them, are governed by the law of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.

10.2 This site is operated by Find-Care Limited, registered in England and Wales, company number 17403068, with its registered office at 44-48 North Road, Lancaster, Lancashire, United Kingdom, LA1 1PA.
